Often it is not necessary to go to court to make a recovery on your personal injury case, this is called a settlement. Most personal injury cases will settle prior to trial. If there are questions about how your injury was occurred, such as who was at fault or how extensive your injuries are, the insurance company may resist your case and therefore litigation in court would be the only alternative.
